PRACTICE NOTE No 122
AMENDMENT TO PRACTICE NOTE 98
PURSUANT TO S52 OF THE CRIMINAL PROCEDURE ACT 1986
Practice Note No 98 issued on 22 April 1998, as qualified by Practice Note No 113, is amended by the addition of a new paragraph 1A:
“1A The following indictments are also excepted from the direction contained in clause 1 hereof to present indictments in the District Court, namely indictments after 1 October 2001 relating to offences for which the maximum penalty is life imprisonment in a case in which either the Director of Public Prosecutions (Commonwealth) or the Director of Public Prosecutions of New South Wales has formed the opinion that the imposition of a life sentence may be appropriate.”
